Terms of Service

These Terms of Service ("Terms") govern your use of the For Samuel mobile application ("App") operated by Kin Tho (ABN 37 320 140 514) ("we", "us", "our"). By creating an account or using the App you agree to these Terms.
1. The service
For Samuel is a care coordination tool that allows authorised household members to share shift schedules, care logs, wall posts, and related care information. The App is intended for use by adults (18+) or by minors under the direct supervision of a parent or guardian who holds the account.
2. Accounts
- You must provide accurate information when creating an account.
- You are responsible for maintaining the confidentiality of your account credentials.
- You must notify us immediately at hello@forsamuel.com.au if you suspect unauthorised access to your account.
- One person may not maintain multiple accounts.
3. Acceptable use
You agree not to:
- Use the App for any unlawful purpose or in violation of any applicable law.
- Enter false, misleading, or fraudulent care records.
- Share your account credentials with people who are not authorised members of your care household.
- Attempt to reverse-engineer, decompile, or extract source code from the App.
- Use the App to transmit spam, malware, or other technically harmful content.
- Post content to the household wall or other shared surfaces that is abusive, threatening, harassing, or that depicts or promotes harm to any person — including material of the kind covered by Australia's Online Safety Act 2021 (such as cyber-abuse material or non-consensual intimate images).
- Interfere with the App's servers or infrastructure.
We may remove or disable access to any content that breaches this section, and we will act on lawful removal notices from the eSafety Commissioner or an equivalent regulator within the required timeframe. Household admins can also remove any post within their own care household at any time.
4. Care data responsibility
You are solely responsible for the accuracy and completeness of care data you enter. For Samuel is a coordination and documentation tool — it is not a medical device, does not provide medical advice, and does not replace professional medical judgment. For Samuel does not validate the clinical accuracy, dosage safety, or completeness of the information you enter. Never rely on For Samuel as the sole source of truth in a medical emergency. Always contact emergency services (000 in Australia) where required.
4A. Care Plan outputs — scope limit
The My Care Plan subscription generates structured documents (Lived Experience Statements, Annual Review submissions, Access Request letters, Variation request letters, Cover Letters of Joy, Care Snapshots, Regulation monthly reports). These documents are compiled from records you maintain in For Samuel. For Samuel is not a registered planner, support coordinator, allied health practitioner, or legal advisor under any funding scheme (including the NDIS), and the documents For Samuel generates do not carry the signature, accreditation, or professional authority of any such role.
Outcomes from any plan review, access request, variation request, or other interaction with your funding body, plan manager, or their representatives are determined by that body — not by a document generated through For Samuel. The same scope limit appears in the footer of every Care Plan document so any party reading the document understands its provenance.
5. Subscriptions and in-app purchases
- Provider Pro (AU$19.99/month, or AU$149/year): Grants access to professional invoice generation features for support workers and independent providers. Available as a monthly or annual subscription. A time-windowed Founder Launch is offered as two separate products (the "Founder Launch SKUs"): AU$9.99/month and AU$99/year. Subscribers to a Founder Launch SKU keep their original rate (AU$9.99/month or AU$99/year, depending on which SKU they subscribed to) for as long as their subscription stays continuously active — Apple App Store and Google Play support permanent price-lock grandfathering on a per-SKU basis, and we commit to electing Apple Connect's "Preserve current price for existing subscribers" on every standard-SKU price change so the platform enforces the grandfathering at each renewal. The Founder Launch SKUs may be retired by us at any time; subscribers who are already on a Founder Launch SKU keep their original rate, and new sign-ups after retirement see only the standard Monthly and Annual tiers. A re-subscribe after cancellation or payment lapse is a new subscription at the then-current available Provider Pro price; the previous Founder Launch grandfathering does not carry over a gap. Automatically renews for the period you select unless cancelled at least 24 hours before the renewal date. Manage or cancel via your App Store or Google Play account settings.
- My Care Plan (AU$89/year): Annual subscription granting access to the Care Plan editor, composer outputs (Lived Experience Statement, Annual Review submission, Access Request letter, Variation request, Cover Letter of Joy), and Care Snapshot PDF / CSV export — for household admins. A time-windowed Founder Launch is offered as a separate product (the "Founder Launch SKU") at the same AU$89/year price; subscribers to the Founder Launch SKU keep AU$89/year for as long as their subscription stays continuously active, even after we raise the standard My Care Plan price for new sign-ups. The Founder Launch SKU may be retired at any time; subscribers who are already on it keep their original rate, and new sign-ups after retirement see only the standard My Care Plan price. A re-subscribe after cancellation or payment lapse is a new subscription at the then-current My Care Plan price; the previous Founder Launch grandfathering does not carry over a gap. Automatically renews annually unless cancelled at least 24 hours before the renewal date. Manage or cancel via your App Store or Google Play account settings.
What happens when My Care Plan is cancelled or lapses:
- Previously generated outputs (Lived Experience Statements, Annual Review submissions, Access Request letters, Variation requests, Cover Letters of Joy, Care Snapshots, Regulation monthly reports) remain part of your account data and are available through Settings → Sync & Data → "Download my data."
- Plan content you authored (sections, citations, evidence links you created between sections and logs / shifts / appointments) remains yours and remains available through "Download my data." Editing plan content, adding new evidence links, viewing composer history in-app, generating a new output document, regenerating an existing one with fresh data, or exporting paid output formats from the app requires an active subscription. The Care Plan surfaces will show a "Reactivate" prompt where subscription-only actions are unavailable.
- Care Snapshot in-app view (the period-aggregated dashboard) remains accessible; exporting the Snapshot as PDF / CSV requires an active subscription.
- All prices are in Australian dollars and inclusive of any applicable GST.
- Refunds are handled by Apple (App Store) or Google (Google Play) pursuant to their respective refund policies. Our Refund Policy explains the store refund routes and the statutory rights (including under the Australian Consumer Law) that store policies do not displace.
- The core App is free for all household members. Subscriptions are optional features for support workers and household admins.
5A. Launch free-access period
For accounts created during our launch period, both subscription tiers described in section 5 (Provider Pro and My Care Plan) are available free of charge for 90 days from the date your account is created. During your free-access period:
- No payment method is collected and nothing is charged. The free-access period is not a free trial of an auto-renewing subscription — it does not convert into a paid subscription automatically, and you will never be charged unless you separately choose to subscribe through the App Store or Google Play.
- The free-access period is personal to your account and runs from your own signup date. It is not extended by re-registering, creating additional accounts (which section 2 already prohibits), or joining another care household.
When your 90-day free-access period ends:
- You will see an in-app notice, and the subscription features remain available for a further 7-day grace period so you are not cut off mid-task.
- After the grace period, the features in section 5 become available only with an active paid subscription at the prices then offered (which may include promotional rates such as the Founder Launch SKUs described in section 5). The lapse behaviour described in section 5 applies — everything you created remains part of your account data and remains available via Settings → Sync & Data → "Download my data"; only the paid actions become unavailable.
- The free core App (section 5) is unaffected and remains free.
We may end the launch free-access offer for new account signups at any time. Ending the offer does not shorten the 90-day period of any account that has already been created. The free-access period is a launch benefit, not a promise of a particular future price; the prices available when your free-access period ends are those described in section 5 at that time.
6. Intellectual property
The For Samuel name, logo, and software are the intellectual property of Kin Tho (ABN 37 320 140 514). Your care data remains your property. You grant us a limited licence to store and process your data solely to provide the service to you.
Some nutrition reference figures shown in the App are derived from the Australian Food Composition Database (Release 3) published by Food Standards Australia New Zealand (FSANZ), used under the Creative Commons Attribution-ShareAlike 3.0 Australia (CC BY-SA 3.0 AU) licence. These figures are estimates that can vary by batch and brand and are not a substitute for professional dietary advice.
7. Privacy
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
8. Service availability and discontinuation
8.1 Availability. We aim to keep For Samuel available at all times but do not guarantee uninterrupted access. We may perform maintenance, update the App, or suspend access for reasons outside our control. We will provide reasonable notice of planned downtime where possible.
8.2 Permanent discontinuation of the App. We may permanently discontinue the App, including because it is no longer commercially viable for us to operate. If we do:
- We will give you at least 90 days' written notice by email and in-app notification before the App stops accepting new data.
- During the notice period, you can continue to use the App, export a complete copy of your data via Settings → Sync & Data → "Download my data" (the right described in section 8 of the Privacy Policy), and cancel any active subscription.
- Within the final 30 days of the notice period, the App will switch to read-only mode — you can still view and export your records, but no new entries can be created.
- At the end of the notice period, the App will stop accepting new data and your records will be deleted or anonymised in accordance with the Privacy Policy.
- Active paid subscriptions will be cancelled at the end of the notice period. Any refunds for unused subscription periods will be handled by Apple (App Store) or Google (Google Play) under their respective policies.
8.3 Discontinuation of a specific subscription product. We may discontinue an individual subscription product (for example, My Care Plan or Provider Pro) without discontinuing the App itself. If we do, we will give you at least 60 days' written notice. During the notice period, your subscription continues to work as normal. At the end of the notice period, the subscription will end and your access to the paid features in that tier will revert to the free tier of the App. Any data you created using the paid feature stays in your account and remains available via "Download my data."
8.4 Promotional rates. Withdrawing a promotional rate means we stop offering it to new sign-ups; it does not allow us to unilaterally change the rate of an active, continuous subscription that locked in a promotional rate at sign-up. Promotional rates (including any launch rate described in section 5) persist only for the life of an active, continuous subscription to the relevant product. They do not survive cancellation, payment lapse, or discontinuation of the App or the subscription product itself (the bounds set out in 8.2 and 8.3).
9. Limitation of liability
To the maximum extent permitted by Australian law, Kin Tho (ABN 37 320 140 514) is not liable for any indirect, incidental, special, or consequential loss arising from your use of the App. Our total liability to you for any claim arising from these Terms is limited to the greater of AU$50 and the amount you paid us in the 12 months prior to the claim.
Nothing in these Terms limits any rights you have under the Australian Consumer Law, including statutory guarantees that cannot be excluded.
10. Termination
You may delete your account at any time via Settings → Danger Zone → Delete My Account. If you breach these Terms, we will normally contact you first and give you a reasonable opportunity (at least 7 days) to remedy the breach before suspending or terminating your account, except where the breach is serious — such as unlawful use, harm to another person, or a security threat to the service — in which case we may suspend access immediately while we investigate. Upon termination, your data will be deleted in accordance with our Privacy Policy.
11. Governing law
These Terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved in the courts of New South Wales.
12. Changes to these Terms
We may update these Terms. We will notify you of material changes via in-app notification or email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
13. App Store and platform-specific terms
These additional terms apply when you obtain For Samuel from a specific application marketplace.
13.1 Apple App Store (iOS users). If you obtained the App from the Apple App Store, you acknowledge and agree:
- Parties. These Terms are an agreement between you and Kin Tho (ABN 37 320 140 514), and not with Apple Inc. ("Apple"). Apple is not a party to these Terms and is not responsible for the App or its content. Kin Tho — not Apple — is solely responsible for the App and for addressing any claims you or any third party have relating to the App.
- Scope of licence. Your licence to use the App is non-transferable and limited to use on any Apple-branded products you own or control, subject to the Apple Media Services Terms and Conditions Usage Rules. The App may be accessed and used by other accounts associated with you via Family Sharing where Apple permits.
- Maintenance and support. Kin Tho is solely responsible for providing any maintenance and support services for the App. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App.
- Warranty. Kin Tho is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) of the App to you; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
- Product claims. Kin Tho — not Apple — is responsible for addressing any claims by you or any third party relating to the App or your possession and use of the App, including (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with the App's use of any third-party software, services, or data.
- Intellectual property. In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Kin Tho — not Apple — will be solely responsible for the investigation, defence, settlement, and discharge of any such claim, to the extent required by these Terms.
- Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Developer contact. Questions, complaints, or claims with respect to the App should be directed to: Kin Tho, ABN 37 320 140 514, Australia — hello@forsamuel.com.au.
- Third-party terms. You agree to comply with applicable third-party terms of agreement when using the App.
- Third-party beneficiary. You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
13.2 Google Play (Android users). If you obtained the App from Google Play, your use of the App is also subject to the Google Play Terms of Service. Kin Tho — not Google — is responsible for the App and for addressing any claims you or any third party have relating to the App. Refunds for in-app purchases are handled by Google pursuant to its refund policies.
